These Terms and Conditions (hereinafter the “Terms”) set out the terms of use of the online shop operated by LCD PARTNERS LLC ALDA MIGUENS SOLE MBR, a single-member limited liability company, 30 N Gould St, Sheridan, WY 82801, United States, trading as Nuala Dublin (hereinafter “we” or “the Provider”), and of the goods and services we offer.

3. Purchase of goods and formation of the contract
The product information, prices, stock levels, promotional content, etc. stated on our website may be changed without prior notice.
By completing the ordering process, you submit an offer to purchase to us.
Even after an order confirmation email has been sent, we may cancel an order if an item is out of stock, a price was displayed incorrectly, there is a problem with the payment, a fraudulent order is suspected, there is a shipping problem or other circumstances exist that we consider make this necessary.
The contract of sale is concluded as soon as we accept the order and begin preparing it for dispatch.
To place an order, select the item, size and colour and add it to your bag, open your bag and go to checkout, enter your contact and delivery details and choose a payment method. The colour, texture, perceived size, etc. of an item may differ from the actual item depending on your monitor, device, settings and the conditions under which the photographs were taken.
We reserve the right to change product information, prices, delivery terms and terms of sale without prior notice. This does not affect orders already placed.

If a payment is not completed properly, we may put the order on hold or cancel it.
6. Shipping and delivery
The time of dispatch, shipping method, shipping costs and estimated delivery time are as stated on the product page, at checkout, in the Shipping Policy or in the order confirmation email.
Our items may be dispatched directly by partner suppliers or from warehouses abroad.
Depending on the destination country or region, customs clearance, weather, the situation of the carrier, peak periods and other circumstances beyond our control, delivery delays may occur.

7. Customs duties, import taxes and additional costs
For items shipped from abroad, customs duties, import VAT, customs clearance fees or other additional costs may be charged in the destination country or region.

8. Returns, exchanges and refunds

If an item is damaged, has an initial defect, was sent in error or has any other problem for which we are responsible, please contact us within the period we have set after receipt of the goods, stating your order number and including photos of the item concerned and a description of the problem, at the following email address:
Whether returns or exchanges for reasons for which the customer is responsible are possible, the time limit, who bears the cost of return shipping and the refund method are governed by our Returns and Refunds Policy.
Returns or exchanges cannot be accepted in the following cases:
Where the contact period we have set after receipt of the goods has been exceeded
Items that have been used, washed, altered or damaged
Items that have become soiled, damaged or lost while in the customer's possession
Items that cannot be returned for reasons of hygiene
Sale items, pre-orders, made-to-order items or other items expressly marked as excluded from returns
This does not affect your statutory right to cancel, described on our Right to Cancel page, or your statutory rights if an item is faulty, which apply regardless of the contact period and the cases listed above.
9. Changes to and cancellation of orders
After an order has been placed, a change or cancellation may only be possible before preparation for dispatch has begun.
As a rule, cancellation is not possible once preparation for dispatch has begun.

Incorrect details may lead to delivery delays, failed delivery, cancellation of the order or additional costs.
In this case we are not liable, unless there is intent or gross negligence on our part.

However, if an item is not in conformity with the contract, is defective, is damaged or was sent in error, we will act in accordance with the statutory provisions and our Returns and Refunds Policy.

16. Limitation of liability
We are not liable for indirect damage, special damage, loss of profit, loss of data, loss of business opportunities or any other damage you suffer in connection with the use of our website, goods or services, unless there is intent or gross negligence on our part.
Where the contract is a consumer contract, this section applies only to the extent that it does not conflict with applicable consumer protection laws.

The invalid or unenforceable provision shall be replaced, to the extent permitted by law, by a provision that comes closest to the purpose of the provision concerned.

In the event of a breach of these Terms, we may suspend or terminate the use of the services by the customer concerned.
Even after suspension or termination, payment obligations and other responsibilities incurred up to that point remain in place.
20. Governing law and jurisdiction
These Terms are governed by and construed in accordance with the law of the state in which the Provider has its registered office.
Mandatory consumer protection rights in the country or region where you live are not restricted by this.
Unless otherwise required by law, the court with jurisdiction for the Provider's registered office shall have jurisdiction (at first instance) over disputes in connection with these Terms or our services. This does not affect your right to bring proceedings in the courts of Ireland.
